A realistic estimate would be 15 to 18 months from the time the Estate is opened until it is closed.
There are specific timelines that prevent a full estate from closing much earlier than that, no matter how expeditiously you work. On the other hand, a complex estate may take years to close.
Studies have shown that the total cost of the procedure of probate is statistically between 5 and 8 % of the gross estate. These costs include the fees charged by the Court, attorneys’ fees, and other fiduciary fees (ex. guardians, or attorneys charged with finding unknown heirs), and accounting fees.
Typically, the larger the estate, the smaller the percentage, and vice versa, because the work involved in getting an asset through probate takes a similar amount of time regardless of the size of the asset or account.
It is not unusual for an heir to hire his/ her own lawyer. It is typically better for the estate if this does not happen, as it can increase total costs exponentially.
However, if there are valid disputes, then sometimes having several attorneys involved to negotiate a resolution can be helpful. Every beneficiary has the legal right to hire representation, so that isn’t something an Executor can control.
